Terms of Service — BabbitAI

These Terms of Service ("Terms") govern your access to and use of BabbitAI ("Service"), operated by Altaf Ebrahim as a sole proprietorship ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

BabbitAI is an AI-powered social media ghostwriting platform. You provide writing samples to train a voice profile, and we use that profile — together with the Anthropic Claude AI model — to generate social media content on your behalf ("Babbits"). The Service also includes tools such as media upload analysis, a LinkedIn profile roaster, and social media scheduling features (where available).

2. Eligibility

You must be at least 18 years old and legally able to form a binding contract to use BabbitAI. By using the Service you represent that you meet these requirements.

3. Your Account

You are responsible for keeping your credentials secure.
You are responsible for all activity under your account.
You must provide accurate information when registering.
You may not share, sell, or transfer your account to another person.

4. Subscriptions and Billing

BabbitAI offers a free tier and paid subscription plans (Creator, Agency, Agency Pro, Enterprise). Paid plans are billed monthly or annually via Stripe. By providing a payment method you authorise us to charge your plan fee on each renewal date.

Cancellation: You may cancel at any time from your billing settings. Cancel at least 1 day before your renewal date to avoid being charged for the next billing cycle — either way, access continues through the end of the cycle you've already paid for.
Refunds: Payments are non-refundable, except for (a) a duplicate or erroneous charge, or (b) a charge processed after your cancellation should have already taken effect. Contact support through the app and we'll refund the erroneous charge.
Service credit for outages: If a platform outage or a failure on our end (including an AI generation that consumes credits without producing usable output) keeps you from using the Service, you'll receive a credit toward your next billing cycle instead of a refund: 25% if the issue is resolved within 5 business days, or 50% if it takes longer than 5 business days to resolve.
Price changes: We will give you at least 30 days notice before changing your plan price.
Failed payments: If a payment fails, we will retry; after repeated failures, your account may be downgraded to the free tier.
Free tier credits: The free tier includes 5 starter Babbits granted once when you sign up — this is a one-time lifetime allowance, not a monthly refresh. To prevent abuse, fraud, and duplicate free-credit claims, we may use limited device and signup signals when you create an account, as described in our Privacy Policy. We do not use these signals for advertising or marketing.

5. Acceptable Use

You agree not to use BabbitAI to:

Generate content that is defamatory, harassing, threatening, or hateful.
Impersonate another person or entity.
Violate any applicable law or regulation.
Spam, phish, or send unsolicited communications.
Circumvent platform rate limits, usage caps, or access controls.
Reverse-engineer, scrape, or copy our AI prompts or pipeline.
Use the Service to train or fine-tune a competing AI model.

We reserve the right to suspend accounts that violate these rules without prior notice.

6. AI-Generated Content

Content generated by BabbitAI is produced by the Anthropic Claude model based on your voice profile and instructions. You acknowledge that:

AI-generated content may occasionally be inaccurate, incomplete, or inappropriate — review it before publishing.
You are solely responsible for reviewing and deciding whether to use any generated content.
BabbitAI does not guarantee that generated content is original or free from third-party intellectual property claims.

7. Intellectual Property

You retain ownership of the writing samples, photos, videos, and audio you submit, and the generated Babbits you publish. By uploading any of this content, you grant us a limited, non-exclusive licence to process it solely to provide the Service — including sending photos/video frames to Claude Vision, audio to Groq's Whisper API for transcription, and media you attach for direct posting to the relevant social platform.

BabbitAI and its logo, design, and underlying technology are owned by us. You may not copy, modify, or distribute our product without our written consent.

8. Social Platform Connections

When you connect a social account (LinkedIn, Instagram, or TikTok), you authorise BabbitAI to post content on your behalf using that platform's API, subject to each platform's own Terms of Service. You may revoke this authorisation at any time from your social connections settings or directly from the relevant platform's settings. We store only the access tokens required to perform the authorised actions and never store your passwords.

9. Limitation of Liability

To the maximum extent permitted by law, BabbitAI will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Service. Our total liability to you will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

10. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or suitable for your particular purpose.

11. Termination

You may delete your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or at our discretion with reasonable notice. On termination, your voice profiles and stored content will be deleted within 30 days.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict-of-law principles.
